Terms and Conditions for InstaDocs

Welcome to InstaDocs!

These Terms and Conditions ("Terms") govern your download, access, and use of the InstaDocs mobile application (the "App"), operated by JAYDARSH TECHNOCRATS LLP ("we," "us," or "our").

By downloading or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Use of the Application

InstaDocs provides tools for scanning, viewing, merging, and editing PDF documents and images locally on your device.

• You are granted a non-exclusive, non-transferable, revocable license to use the App strictly in accordance with these Terms.
• You agree not to use the App for any illegal, unauthorized, or unethical purposes.
• You are solely responsible for the content of the documents and images you process using the App.

2. Local Processing and Data Liability

InstaDocs performs document operations locally on your device. An active internet connection may be required to access certain features and display advertisements.

• No Cloud Backups: We do not store, back up, or have access to the files, images, or PDFs you create or modify using the App.
• Data Loss: You are solely responsible for backing up your files. We are not liable for any data loss, file corruption, or accidental deletion that occurs while using the App.
• Passwords: The App allows you to lock PDFs with a password. If you forget the password, the document cannot be recovered by us. We are not responsible for inaccessible documents due to forgotten passwords.

3. Third-Party Services, Analytics and Advertisements

The App is free to use and is supported by advertisements and performance analytics. To provide a functional, stable, and optimized experience, we use third-party services provided by Google:

• Google AdMob: We use AdMob to serve ads. By using the App, you consent to the display of these advertisements.
• Google Firebase Analytics: We use Firebase Analytics to collect anonymous application performance metrics, stability data, and usage analytics.

Your relationship with these third-party services is subject to their respective Terms of Service and Privacy Policies.

4. Intellectual Property

All intellectual property rights in the App, including its original code, design, features, functionality, and the "InstaDocs" brand, are owned by us. You may not copy, modify, distribute, sell, or lease any part of our App without our prior written consent.

5. Disclaimer of Warranties

The App and all included features, tools, and services are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

• We strictly disclaim all responsibility for the safety, integrity, or legality of any documents you process using the App.
• We do not warrant that the App will function uninterrupted, be error-free, or be completely secure from unauthorized access.
• We do not guarantee the absolute accuracy of the Optical Character Recognition (OCR) tools, image conversion qualities, or PDF outputs. You use the App entirely at your own risk.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall we (or our developers, affiliates, and partners) be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation, loss of profits, data, use, goodwill, business interruption, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the App.
• Any unauthorized access to or alteration of your local files, device, or transmissions.
• Any errors, mistakes, or inaccuracies in the App's processing or output.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our App by any third party.

In no event shall our total aggregate liability to you for all claims arising out of or relating to the use of the App exceed the amount you paid us to use the App, which is zero (0.00).

7. Indemnification

By using the App, you agree to defend, indemnify, and hold us harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the App;
• Your violation of any term of these Terms;
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right regarding the documents you process;
• Any claim that a document or image processed by you caused damage to a third party.

8. Jurisdiction

Any dispute, claim, or legal proceeding arising out of or in connection with these Terms or the use of InstaDocs shall be subject to the exclusive jurisdiction of the competent courts located in Ahmedabad, Gujarat, India.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time by updating this document. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
